PRIVACY POLICY

 Gas Marketing Srl, with registered office in Via delle Triremi 48 - 00121 Roma (Italy) as the owner of the personal data processing (hereinafter, the “Owner”), informs, according to D.Lgs. 30.06.2003 n. 196 (hereinafter, “Privacy Code”) and UE regulation n. 2016/679 (hereinafter, “GDPR”), that your personal data will be treated in the manner and for the following purposes: 

  1. Object of the treatment

The Owner processes personal data, identifying and not sensitive (as an example but not limited to: name, surname, company name, address, telephone number, e-mail address, bank and payment references …, hereinafter "personal data" or "data") provided during website registration process, customer feedback and satisfaction surveys, subscription and online request forms.

  1. Purpose of the treatment

Personal data will be processed, also possibly through the managers and/or agents appointed by the Owner in the manner provided by the current legislation, for the following purposes:

  • Grant website management and customized personal area access
  • Grant the use of requested services
  • Grant access to programs and services
  • Offer remote customer care and advice
  • Contact request processing
  • Billing and administrative purposes
  • Fulfill the obligations provided for by the Law, UE regulation, orders of the Authority (for example in the field of anti-money laundering), Italian or foreign government requests, Chamber of Commerce requests;
  • Prevent and detect fraudulent and harmful activities
  • Exercise the rights of the Owner, such as the right to defense in court.

 

  1. Method of treatment

The processing of personal data is carried out through the operations indicated in art. 4 of the Privacy Code and art. 4 No. 2 GDPR and precisely: collection, registration, organization, conservation, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and data destruction.


The data will be processed using appropriate tools to ensure the security and confidentiality of the same and will be processed both in form paper that electronic and/or automated, also through telematic or innovative channels to store, manage and transmit the data. The Owner will process personal data for the time necessary to fulfill the purposes specified above and in any case for no more than 10 years from termination of the report for the purposes of service and no later than 2 years from the collection for other purposes. According to the requirements of the GDPR, collected personal data are stored for a period of time not exceeding the period of time needed for the purposes they are collected and stored for. 

  1. Security

The Owner implement a wide variety of security measures to protect Data against the risk of loss, misuse or alteration. In particular he adopt the measures stated in Articles 32-34 of the Privacy Code and art. 32 of GDPR. Owner will use, if necessary for safer communications, data encryption technology defined by the AES Standards (BCrypt) and the protected data transmission protocols known as HL7 and HTTPS.

 

  1. Access to data

The data may be made accessible for the purposes referred to in art. 2 ° and 2b:

  • To employees and collaborators of the Data Controller, also in their capacity as agents and / or internal managers of the processing and / or system administrators;
  • To third-party companies or other subjects (credit institutions, professional firms, consultants, insurance companies ...) who carry out outsourcing activities for account of the Owner, in their capacity as external data processors
  1. Data communication

Without the need for express consent (Article 24 letter A-b-d Privacy Code and Article 6 letter B-c GDPR) the Owner may communicate your data for the purposes referred to in art. 2 to Supervisory bodies, Judicial authorities, as well as to those subjects to whom the communication is mandatory by law for the accomplishment of the aforementioned purposes. These subjects will process data in their capacity as data controllers. Your information will not be disseminated.

  1. Data transfer

Personal data is stored on servers located in Italy and/or abroad within the European Union, owned by the Owner and/or third-party companies, appointed as in charge of data processing related to requested services. Provided Data might be transferred abroad, inside and/or outside the European Union, according to limits and conditions of the GDPR, in order to fulfill the purposes related to data transfer itself.

  1. Nature of providing data and consequences of refusing to answer

Providing data for the purposes referred to in art. 2nd is mandatory. Otherwise, we will not be able to guarantee the Services referred to in the same article.

  1. Rights of the interested party

In your capacity as an interested party, you can take advantage of the rights set forth in art. 7 of the Privacy Code and art. 15 GDPR and precisely the rights of:

  1. Obtain confirmation of the existence or not of personal data concerning you, even if not yet registered, and their communication in an intelligible form;
  2. Obtain the indication:
  1. of the origin of personal data;
  2. of the purposes and methods of the processing;
  3. of the logic applied in case of treatment with electronic and / or automated tools;
  4. of the identification details of the Owner, of the managers and of the designated representative pursuant to art. 5 paragraph 2 of the Privacy Code and art. 3, paragraph 1 of the GDPR;
  5. of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as a designated representative in the territory of the State, managers or agents;
  1. To obtain:
  1. updating, rectification or, if interested, integration of data;
  2. cancellation, transformation into anonymous form or blocking of processed data in violation of the law, including those that do not need to be kept for the purposes for which the data were collected or subsequently treated;
  3. the attestation that the operations referred to in letters a) and b) have been brought to the attention, including as regards their content, of those to which the data have been communicated or disseminated, except in the case where such fulfillment is impossible or involves a use of clearly disproportionate means with respect to the protected right;
  1. Oppose, in whole or in part:
  2. for legitimate reasons to the processing of personal data concerning you, even if pertinent to the purpose of collection:
  3. to the processing of your personal data for the purpose of sending advertising or direct sales material or for carrying out market research or communication commercial, through the use of automated call systems without the intervention of an operator by e-mail and / or through traditional marketing methods telephone and / or paper mail. It should be noted that the right of opposition of the interested party, referred to in this point b) for purposes of direct marketing through methods automated extends to traditional ones and that in any case the possibility of exercising the right to oppose even partially remains. Therefore the interested party may decide to receive communications only using traditional or automated methods or none of the two types of communication.

Where applicable, the person concerned has the rights set forth in articles 16-21 GDPR (right of rectification, right to be forgotten, right to limit processing, right to the portability of data, right of opposition) as well as the right of complaint to the Guarantor Authority.

The present website and the related services are not intended for minors under the age of 18 and the Owner does not intentionally collect personal information about minors. In the event that information on minors were unintentionally registered, the Owner will delete them in a timely manner, at the user request.
